Eureka Tutoring Terms and Conditions




Programs are offered for almost all science and math courses from junior high to entry level college difficulty.

The structure of subject tutoring sessions will rely on class materials such as syllabuses, textbooks, available tests or quizzes, and completed homework assignments.  Sessions will be synchronized with the pace of the class.  Tutoring sessions will be used to demonstrate effective study techniques and explain concepts that are unclear to the student. Homework or online resources for the student will be suggested weekly, but completion will not be required. Depending upon the session, homework could consist of written answers to the end of chapter questions, creation and use of flash cards, verbal explanations of concepts to a friend or family member, or any other useful study tools.

Subject tutoring sessions can be requested for any number of sessions.  The duration of subject tutoring sessions can vary between 1.5 and 2 hours depending on the student’s needs.  The recommended frequency of subject tutoring sessions is once a week.


Sessions will require a test preparation book. If one is not already purchased, the student will be required to obtain either the current “The Official ACT Prep Guide” or the current “The Official SAT Study Guide”.  These books cost about $20 and contain valuable information in addition to several practice tests.  The student is responsible for purchasing the corresponding book to the selected program.  Tutoring sessions will include explanations of concepts, review of homework problems, and discussion on how to handle specific types of problems.

Test preparation tutoring sessions can either be requested for a single section, multiple sections, or all sections of a test.  Programs that only cover a single section will only be offered for a minimum of three two-hour sessions.  A program that covers all sections will be offered at a minimum of five two-hour sessions.  The recommended frequency of sessions is once a week.  The duration of two hours is non-negotiable.


Rates will be calculated based on the location of the tutoring session, the duration of the session, and any sale or discount for which the student is eligible. If sessions are held online there will be a $5/hr discounted rate (already reflected in original price) with the exception of the ACT/SAT Test preparation program.  First sessions are free for prospective students. This applies to new customers only. Returning customers are subject to the regular rates for all sessions.


Acceptable methods of payment are: cash, check, credit card, or Paypal. In-person sessions are to be paid at the end of each session or before the beginning of a block of pre-paid sessions. If paying by check, please make out to Eureka Tutoring.


Tutoring will begin on the date and time agreed upon by both the tutor and student.  Changes of regularly scheduled dates and times from week to week is often possible, but is not guaranteed.


For a cancellation of a single session, the student may cancel tuition by giving at least 24 hours’ prior notice to the tutor.

For a cancellation of a single session in a block of pre-paid sessions, the student must give 24 hours’ notice prior to the scheduled session.  An option to reschedule within the week will be offered, but is not mandatory.  If a week is skipped due to cancellation and rescheduling was refused, the block of sessions can be extended by a week, or if the sessions were prepaid, the equivalent of one session will be refunded at the final scheduled session.

Cancellation within less than 24 hours of the session will result in a warning on the first occurrence. On the second occurrence, a fee equal to one hour’s pay will be added to the cost of the next scheduled session.  On the third occurrence, all future tutoring sessions will be cancelled and refunded if previously paid for.


The tutor may cancel lessons by giving 24 hours’ prior notice to the student in which case no fees shall be incurred.  The tutor shall then reschedule the appointment at a time agreeable to both parties.


For the termination of a block of sessions, the student must give one week’s notice from the date of the first session to be cancelled.  This means that termination notice should be given at the end of a tutoring session.  This will result in a full refund of the payment for any remaining sessions.  If the student terminates the block of sessions in less than 7 days, the payment for any remaining sessions will be refunded minus the cost of one full session.


Fees are calculated according to the times stipulated in the schedule and no adjustments shall be made for time lost because of late arrival by the student.


Any lost time because of the late arrival of the tutor shall be compensated by extending a lesson for the amount of time that was lost.


The tutor shall do all preparation prior to lessons and to structure lessons in such a way as to optimize time to the benefit of the student.

The tutor shall keep all student information confidential and shall contact other parties involved in the education of the student only if given written permission by the student (or parent) to do so.

The tutor shall not assign any of his duties or obligations under this tutoring contract to a third party without the written permission of the student

The tutor shall at no time be required or obliged to execute homework or assignments on behalf of the student.


The student agrees to assist the tutor in identifying problem areas in which the student needs specific tutoring.

The student agrees that assignments, exercises, or homework form an integral part of tutoring and agrees to complete such work in a timely manner.  In addition to assignments and homework, communication is key; therefore, the tutor expects a 24 hour response time to any texts or emails.


The tutor makes no promises or guarantees with regards to a specific point increase in a student’s performance as a result of any tutoring provided.  The tutor only notes that a student’s effort will greatly affect how much of a change they will see in performance.


It is expressly understood that the student retains the services of the tutor as an independent contractor and not as an employee.  The tutor shall be responsible for his own insurance and for all statutory declarations and contributions with regard to income tax.


No relaxation, indulgence, waiver, or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms.


This agreement constitutes the entire understanding between the parties with regard to the subject matter thereof and the parties waive the right to rely on any alleged expressed or implied provision not contained herein.  Any alteration to this agreement must be in writing and signed by both parties.


Where the student is a legal minor, the parent or guardian shall enter into this tutoring contract on behalf of the student and shall accept and agree to all the terms and conditions contained herein on behalf of the student.
